Chapter 4. The rights and obligations of citizens in the field of health protection.
Federal Law No. 326-FZ dated 11/29/2010 "On Compulsory Medical Insurance in the Russian Federation"
Article 16. Rights and obligations of insured persons.
1. This procedure for clergymen visiting patients undergoing inpatient treatment at the Federal State Budgetary Institution "FCSSH" of the Ministry of Health of the Russian Federation (Astrakhan) (hereinafter referred to as the Center) has been developed in order to comply with the patient's right to admit a clergyman to him and to practice religious rites when receiving medical care in inpatient conditions, provided for by Federal Law No. 323 dated 11/21/2011-Federal Law "On the basics of public health protection in the Russian Federation".
2. Interaction with a religious organization in order to realize the rights of patients to admit a clergyman and perform religious rites is carried out by a responsible employee.
3. Visits by clergy to patients in inpatient departments of the Center during the provision of planned medical care, as well as the performance of religious rites, are carried out during visiting hours established by this order.
4. For patients in the departments of the Center receiving medical care according to the profile of intensive care and intensive care, as well as for patients in inpatient departments of the Center, in case of a threat to the life of these patients, clergy visits to patients are carried out without taking into account visiting hours established by the order of the Center.
5. Visits to the clergy are carried out in compliance with the requirements of the anti-epidemic regime, including the use of appropriate personal protective equipment.
6. In case of resumption of measures to ensure the sanitary and epidemiological well-being of the population in the Astrakhan region due to the spread of a new coronavirus infection (COVID-19), clergy who have been vaccinated against coronavirus infection or who have a negative result of a PCR test for coronavirus infection, no more than 72 hours ago, are allowed to visit the patients of the Center.
In the case when the patient is in an extremely serious/terminal condition, the clergyman may be admitted to the patient once without complying with the requirement set out in the first paragraph of this paragraph. In this case, the subsequent admission of this clergyman is carried out in compliance with the requirement established in the first paragraph of this paragraph.
The time of the clergyman's visit to the patient should not exceed the visiting time set in the Center: daily, from 15:30 to 19:00 local time. On non–working days, weekends and holidays - additional visits to patients from 10:00 to 12:30 local time.
7. If a clergyman is admitted to the department of anesthesiology and intensive care to patients with a diagnosis implying acute respiratory infection, the responsible employee is obliged to warn the clergyman about the risk of possible infection with acute respiratory infection.
8. The responsible employee is obliged to brief the clergyman on the rules of visiting patients available at the Center, as well as compliance with fire safety when performing religious rites using church candles and other flammable means.
9. Upon receipt of information from the patient about the desire to meet with the clergyman, the medical officer (attending / duty doctor / nurse) makes an appropriate entry in the patient's medical documentation and transmits this information to the responsible employee within 1 (one) working day from the moment of receipt of information from the patient, and in case of a threat to life within 2 (two) hours.
9.1. Within 2 hours, the responsible employee of the Center notifies the religious organization of the need to respect the patient's right to admit a clergyman and practice religious rites when receiving medical care in inpatient conditions, provided for in Article 19 of Federal Law No. 323-FZ dated 11/21/2011 "On the Basics of Protecting the Health of Citizens in the Russian Federation".
9.2. In case of notification by a religious organization, the responsible employee of the Center notifies the guard of the arrival of the clergyman within 1 hour and 30 minutes.
9.3. After the arrival of the clergyman at the security checkpoint, he transmits information about the clergyman to the responsible person.
9.4. The responsible employee arrives at the security post and, after presenting the identity documents by the clergyman, ensures:
- reconciliation of data on the clergyman with the list of clergymen who interact with the Federal State Budgetary Institution "FCSSH" of the Ministry of Health of the Russian Federation (Astrakhan) in order to exercise the rights of patients to admit a clergyman and perform religious rites;
- accompanying the clergyman to the patient, as well as providing the clergyman with individual protective equipment through the nurse of the inpatient department in which the patient is located, in agreement with the senior nurse of the department (head of the department) in which the patient is located;
- instructing the clergyman on the requirements of the anti-epidemic regime, including the use of appropriate personal protective equipment;
- verification (in case of resumption due to the spread of a new coronavirus infection (COVID-19) of measures to ensure the sanitary and epidemiological well-being of the population in the Astrakhan region) of the presence of vaccination against coronavirus infection or a negative result of a PCR test for coronavirus infection, no more than 72 hours ago.
9.5. In case of non-compliance of the clergyman with the conditions of clause 9.4. of the Procedure, the responsible employee does not allow the clergyman to enter the territory of the Center.
9.6. If the clergyman complies with the conditions of clause 9.4. of this Procedure, the responsible employee immediately accompanies the clergyman to the patient in order to exercise the patient's right to admit a clergyman to him and perform religious rites when receiving medical care in inpatient conditions, provided for by Federal Law No. 323-FZ dated 11/21/2011 "On the Basics of Public Health Protection in the Russian Federation".
10. If a clergyman is invited by the patient's representatives in case of a threat to the patient's life, the patient's right to allow a clergyman and religious rites to him when receiving medical care in hospital conditions provided for by Federal Law No. 323-FZ dated 11/21/2011 "On the Basics of Protecting the Health of Citizens in the Russian Federation" is subject to implementation only if a religious organization complies with the obligation no later than than to inform the responsible employee about the visit of the clergyman in two hours, which provides the necessary assistance in organizing the clergyman's visit to the patient and compliance with the requirements established by this Procedure.
11. The number of visits to the patient by the clergyman is not limited, but should be no more than 1 (one) time per day.12. After exercising the patient's right to be admitted to a clergyman and to perform religious rites while receiving medical care in a hospital setting, the clergyman informs the responsible employee about this and the responsible employee accompanies the clergyman to the exit from the institution.
